WE GUARANTEE YOUR TRUST

These General Terms and Conditions, together with any Specific Terms and Conditions that may be established, govern the legal relationship arising from the contracts entered into by: SQUIRREL & FRIENDS S.L. and the users of its online shop, which are provided via the CASTROSEIS.COM website and its associated links. These contracts may be entered into by any user provided they comply with all the terms set out in these Terms and Conditions and in the specific terms and conditions of the various domains.

This document is available at all times for reading and printing on this website, and can be downloaded from here, as established by Royal Decree 1906/1999, regulating Telephone and Electronic Contracting, and Law 7/1996 on the Regulation of Retail Trade (amended by Law 47/2000 of 19 December) insofar as it applies to the provisions on distance selling in Articles 38 et seq.

These terms and conditions govern the relationship between: SQUIRREL & FRIENDS S.L. and customers who purchase products via its website.

These terms shall be binding from the moment any of the products or services offered on the castroseis website are purchased.

The main characteristics of each product are described in their corresponding product details or sections. (Features, price, offers, discounts, etc.).

Offers will be clearly marked and identified as such, clearly indicating the previous price and the offer price.

FEATURES OF THE PRODUCTS ON OFFER

Our online shop brings together leading Nordic design brands, niche brands, emerging artists and responsibly produced goods.

Among the products sold are: furniture, bags and accessories, perfumes, art, and homeware and decorative items.

castroseis is not obliged to compensate the user or third parties for the consequences of using its products, whether direct or indirect damages, nor is it responsible for the materials from which our products are made.

The invoice for the order will be included inside the parcel or envelope for all orders. If, for any reason, you do not find the invoice with your delivery, please notify castroseis and we will send it to you via email.

The items, colours and materials of our customisable products may vary slightly from the samples shown on the website depending on availability, although we will always maintain the highest quality and design features. Please bear this in mind when placing repeat orders that are replicas of the first.

Offers will be marked as such and will remain valid whilst they appear on your screen. These offers may be modified or cancelled without prior notice.

castroseis is not obliged to compensate the user or third parties for the consequences of using its products, whether direct or indirect damages, nor is it responsible for the materials from which our products are made.

PURCHASE CONFIRMATION

Once the purchase has been made and as soon as possible, always within 24 hours of the purchase being completed, castroseis will send by email an order confirmation. If you do not agree with the details stated in this confirmation, you may request a correction to these details or the cancellation of the contract. If the cancellation falls within the accepted criteria, and once the status has been verified, we will refund the order amount, using the same payment method used to make the purchase. If the purchase was paid for using any of the following payment methods (PayPal, Apple Pay, Google Pay, Microsoft Payments, Klarna or Sequra), 5% of the amount to be refunded will be deducted to cover administrative costs.

In any case, notification must be made within 24 hours of order confirmation, via email: HELLO@CASTROSEIS.COM, provided the order has not yet been processed.

SHIPPING COSTS AND DELIVERY TIMES

Shipments will be dispatched once your order has been confirmed and payment has been received in the manner described under “Payment Methods”.

We will first send you an email confirming your purchase and assigning you an order number.

At Castroseis, we take great care with our products to ensure their high quality. We aim to deliver as quickly as possible; however, as most items are made to measure, delivery times may vary depending on the order.

The delivery time indicated for our products is an estimate and may vary due to delays on the part of the supplier; these delays shall not constitute grounds for cancelling the order, as production is already underway.

All our products include free delivery on mainland Spain for all purchases over €50. For purchases under €50 or outside mainland Spain, the delivery charges are as follows:

- Delivery charges for Spain and Portugal: €5.95

- Delivery charges for the Balearic Islands: from €8.95

- Shipping costs for Europe Zone 1 (Germany, France, Monaco, Ireland, Austria, Belgium, Italy, Luxembourg, the Netherlands, Denmark, Slovakia, Slovenia, Poland, the Czech Republic and Switzerland): from €14.95

- Shipping costs for Europe Zone 2 (Bulgaria, Croatia, Estonia, Finland, Greece, Hungary, Latvia, Lithuania, Norway, Romania, Serbia and Sweden): from €29.95

We do not deliver to islands, with the exception of the Balearic Islands.

Delivery is free for the Balearic Islands and Europe Zone 1 on orders over €120, with the exception of all products in the furniture category, for which delivery is free on orders over €1,200.

There is another collection option available only in Spain: Service Point Delivery, which costs €4.95 for mainland Spain, free for orders over €50. For the Balearic Islands, the cost is €7.95, free for orders over €75.

Collection from the castroseis shop in A Coruña (Spain); in this case, there are no delivery charges.

castroseis does not guarantee the availability or delivery times of the products offered on www.castroseis.com, except for those products where availability is expressly stated (products in stock), marked with the message EXPRESS DELIVERY. The delivery time for these products is between 24 hours and 7 days, depending on the area and type of delivery.

Delivery times apply to items in stock and orders placed Monday to Friday before 10:00 am. For orders placed at weekends or after 10:00 am, the delivery period begins on the next working day, Monday to Friday, excluding public holidays.

Delivery will be made to the address and in the name of the person provided during the purchase process. Before you place your order, we will inform you of the expected delivery details. Orders will be considered delivered once the customer has signed the goods receipt document. It is the customer’s responsibility to check the condition of the parcel and to report any issues, such as damage to the packaging or discrepancies between the contents and the items purchased.

If you detect any damage to the delivery or any other issues, these must be reported within 24 hours of receiving the parcel. To do so, you may contact us by replying to any of the emails received during the purchase process, or via any of the methods we provide, such as the contact form, telephone, or WhatsApp. You must specify the issue with your order and attach photos of the outer packaging where the label is visible, as well as as many images as possible to document any damage or error.

It is the customer’s responsibility to receive their delivery. At Castroseis, we will do our utmost to ensure the delivery is as convenient as possible for the customer, but we cannot guarantee that the courier companies will be able to deliver within a specific time slot, as this often depends on delivery routes and locations.

Occasionally, the courier returns undelivered orders to our premises because the recipient was absent from the postal address indicated on the parcel, or because the postal address was incorrect, and we were unable to make contact by any means. In such cases, our company will notify the customer of this issue to arrange a new dispatch with the correct postal address confirmed. In this case, as a new shipment must be arranged, payment must be made in advance. In the event of a new shipment due to an error in the customer’s address, the delivery charges will also be charged again.

If the customer is not present at the delivery address on several occasions, the courier company will redirect the shipment to a collection point, usually with extended opening hours, where the shipment can be collected. If the customer refuses delivery, fails to collect the parcel from the collection point within a few days of it being deposited there, and the parcel is returned to our premises, they must bear the cost of a new delivery, should they wish to proceed, or the delivery charges will be deducted from their refund, in accordance with the rates indicated for non-free deliveries.

Should the user fail to respond to our notifications, we will retain the parcel at our premises for a maximum of 3 months. After this period, the parcel will be destroyed.

Please note that products in the “Furniture” category and its subcategories are delivered via a door-to-door service to the street level. This does not include carrying the goods to a different floor, unpacking or assembly.

TERMS AND PAYMENT METHODS

The user/buyer undertakes to pay for the products purchased from castroseis using the accepted payment methods and for any additional amounts (including taxes and late payment charges, where applicable).

Card, PayPal, Google Play, Apple Pay, Microsoft Pay, Klarna, Sequra and Cetelem.

No other payment methods are accepted.

Payment must always be made in advance for 100% of the order, and items will be dispatched once payment has been confirmed.

VALIDITY OF PRICES AND OFFERS

The products and services offered on the website, and their prices, will be available for purchase whilst they appear in the product catalogue displayed on the website. Users are advised to access updated versions of the website to avoid pricing errors. In any case, orders currently being processed will retain their terms and conditions for 7 days from the time of placement.

RETURNS AND CANCELLATION OF PURCHASES

Cancellation is the right of a consumer to return goods to the retailer within a statutory period, without having to provide any justification or explanation, and without incurring a penalty.

The withdrawal period is 14 days from the date of receipt of the product.

In the case of products offered by castroseis that are made to customer specifications and/or personalised, indicated as made-to-order items, THE RIGHT TO WITHDRAW FROM THE PURCHASE IS NOT ACCEPTED.

In accordance with Law 3/2014 of 27 March, amending the revised text of the General Law for the Protection of Consumers and Users, the following are considered Exceptions to the Right of Withdrawal pursuant to Article 103.c of the aforementioned law; the right of withdrawal does not apply to the delivery of:

“Goods made to your specifications or clearly personalised”


For health and hygiene reasons, we do not accept returns of unsealed cosmetic products (perfumes, creams, balms, soaps, gels, etc.).

The exception to the right of withdrawal applies in both cases.

Returns:

We undertake to accept returns and to bear the costs of the return  ONLY in the following cases:

- An item has been sent instead of another
- The item is faulty (has defects, stains, etc.) and this has not been previously notified/reported.

If the conditions for a return are met:

In accordance with current regulations, the customer has a period of 14 calendar days from the date of receipt to return an order in the two accepted cases. We will check that the product is in normal condition and shows no signs of tampering.

The right of withdrawal cannot be exercised in the following cases:

- The product or packaging is in poor condition
- The product is incomplete, accessories are missing, or it has been tampered with and/or broken
- Instructions or any other documentation are missing
- The proof of purchase and delivery note are not provided
- Products with obvious signs of use and tampering
- Any item that is not in its original condition, is damaged or has missing parts for reasons beyond the company’s control
- Where the products have been knocked or damaged
- Hygiene products that have had their seals broken
- Where the non-conformity is due to wear and tear resulting from normal use
- If not all components, accessories, cases or boxes are returned with the product
- Any product returned more than 14 days after dispatch

To initiate a return process, you must first contact us via email at HELLO@CASTROSEIS.COM, where we will provide instructions on how to send the order back to us. We will not accept returns without the aforementioned prior notification.

If the reason for returning an order or part thereof is not covered by the list above, we will not refund the cost of the item or the return postage. Example: if you are not satisfied with the design, colour or quality of the item, etc.

castroseis will not accept carriage forward or cash on delivery shipments, nor those for which neither the delivery nor return costs have been paid.

The product must be in perfect condition and include all its accessories.

If the return meets the accepted criteria and its condition has been verified, we will refund the order amount, minus the delivery costs, using the same payment method used for the purchase. If the purchase was paid for using any of the following payment methods (PayPal, Apple Pay, Google Pay, Microsoft Payments, Klarna or Sequra), 5% of the refundable amount will be deducted to cover administration costs.

The customer must retain the original packaging, as the product will be subject to a reduction in value if it is not returned in its original packaging. We recommend that, if returning an opened product, you repack it very carefully using all the protective materials we supplied at castroseis; please bear in mind that it may be subject to knocks during transit and if we receive it badly damaged, we will have to apply an additional charge for the resulting depreciation of the product.

For the refund, the customer may choose between a Discount Voucher, a credit to their user account, or a refund of the amount paid.

The maximum timeframe for receiving the refund amount is 14 calendar days via the payment method used for the order. If you have not received the refund amount for an accepted return by this date, please contact us via email at HELLO@CASTROSEIS.COM.

We will process the refund within 14 calendar days from the date we approve your return.

DISCOUNTS AND PROMOTIONS

Occasionally, we create codes so you can purchase a Troseis product at a significant discount.

To apply the discounts, simply visit our online shop and purchase the product associated with that code. During the checkout process, you will be given the option to enter the promotional code before making payment; once entered, the discount will be applied to the item immediately.

A promotional code may also offer a discount on your entire online purchase; in this case, entering the code during the checkout process will automatically apply the discount to your entire order.

We also have a “Special Prices” section with direct discounts applied to products.

WARRANTY

Customers are reminded of the existence of a legal warranty of conformity for goods, the existence and conditions of after-sales services, and commercial guarantees. All items sold by castroseis are guaranteed in terms of quality.

The guarantee for items sold by castroseis is valid for 2 years for private users, as provided for by Law 23/2003 of 10 July on Guarantees in the Sale of Consumer Goods; this period may be adjusted depending on the nature of the product in question. The consumer and user must inform the seller of any lack of conformity within two months of becoming aware of it.

The warranty shall cease to be valid in the event of defects or damage caused by external factors, accidents (in particular electrical accidents), wear and tear, incorrect washing, or use not in accordance with the instructions on the Supplier’s label.

The warranty shall not apply to apparent defects or non-conformities of the product; any claim in this regard must be made by the user in question within 7 days of delivery of the products. The warranty does not cover products damaged by improper use.

The images on the website are not contractually binding; they are intended to be as close as possible to the finished product, given the wide range of variations that products may undergo due to customisation. The warranty does not cover any discrepancy between the product received and the image displayed on the website.

COMPLAINTS

The user may make a complaint by sending an email to HELLO@CASTROSEIS.COM, stating their full name, the product purchased and the reasons for their complaint.

DISPUTE RESOLUTION PLATFORM

The European Commission has created the first European platform for the resolution of disputes in online commerce, in accordance with the latest consumer legislation. In this regard, as operators of an online sales platform, we have a duty to inform all users of the existence of an online alternative dispute resolution platform.

If you have a complaint, or believe that we have not handled your complaint satisfactorily, please contact us before submitting a complaint via the Online Dispute Resolution platform. At Castroseis, we take customer service very seriously and adhere to the highest standards when it comes to managing, responding to and resolving our customers’ concerns.

DISCLAIMER

castroseis, reserves the right to make, at any time and without prior notice, modifications and updates to the information contained on the Website, its configuration and presentation, the terms of access, terms and conditions, etc. The USER must therefore access updated versions of the website.

castroseis shall not be liable for any loss arising from the improper or unauthorised use of the website.

The user is solely responsible for maintaining the confidentiality of their password and is solely responsible for all activities resulting from the use of the password on the pages developed by CASTROSEIS.COM. The user undertakes to hold CASTROSEIS.COM harmless from any claims, losses, expenses, damages and costs (including direct, incidental, consequential, punitive, exemplary and indirect damages), and reasonable legal fees resulting from any breach by the user/purchaser of these terms and conditions, whether or not considered material or immaterial; the use or misuse of the Services by you or any person acting on your behalf or using your account on CASTROSEIS.COM, or any material or immaterial infringement of any rights, title or interests of third parties.

Under no circumstances shall CASTROSEIS be liable for any breach of contract by the user, negligence regarding the site, the service or any content, for any loss of profits, loss of use, or actual, special, indirect, incidental, punitive or consequential damages of any kind arising from your misuse of the tools provided.

Our sole liability shall be to supply the product in accordance with the terms and conditions set out in this contract policy. castroseis shall not be liable for any consequences, damage or loss that may arise from the improper use of the products supplied.

LANGUAGE

The language in which the contract between castroseis and the Customer shall be concluded is Spanish.

JURISDICTION AND APPLICABLE LAWS

These Terms of Use are governed by Spanish law. These Terms of Use are subject to the provisions of Law 7/1998 on General Contract Terms, Royal Legislative Decree 1/2007 on Consumers and Users, Royal Decree 1906/1999, regulating Telephone and Electronic Contracting, Law 7/1996 on the Organisation of Retail Trade, and Law 34/2002 on Information Society Services and Electronic Commerce.

In accordance with Article 29 of Law 34/2002 of 11 July on Information Society Services and Electronic Commerce, contracts concluded electronically to which a consumer is a party shall be presumed to have been concluded at the place where the consumer has their habitual residence.

Electronic contracts between businesses or professionals and users shall be deemed to have been concluded at the place where the service provider is established. In the event of any dispute arising from these general terms and conditions and for the resolution of such disputes, the parties submit, at their discretion and waiving any other jurisdiction, to the courts and tribunals of the User’s place of residence.
